FLOUTING CONTRACTUAL OBLIGATIONS, DEFYING COURT ORDERS, AND DISREGARDING ARBITRATION: THE FACTS BEHIND HADIZA BALA USMAN'S ABUSE OF OFFICE AS NPA MD

We have taken note of recent public statements made by Ms. Hadiza Bala Usman, the former Managing Director of the Nigerian Ports Authority (NPA), who was sacked from office. In her comments, she accused BUA Group and our Chairman, Abdul Samad Rabiu, of breaching a concession agreement and distorting facts. These claims were made in response to our Chairman's interview and article, “Two Years of President Tinubu: A Business Perspective” (watch at https:///pbatbua), which celebrated Nigeria's reform trajectory and referenced prior instances of arbitrary disruptions to business operations, without naming anyone – a situation that has now been curtailed by President Tinubu's no-nonsense approach to bringing sanity and stability to the business environment in Nigeria.


Ordinarily, we would not engage, but the distortions in her response necessitate this factual clarification, especially as they relate to her actions during her tenure as MD of the NPA.

THE CONTRACT AND WHAT SHE OMITTED

BUA entered into a valid long lease agreement in 2006 with the NPA to rehabilitate and operate Terminal B at Rivers Port in Port Harcourt, Rivers State. Long before Ms. Usman's appointment, BUA had begun formal engagement with the NPA to address outstanding remedial works and infrastructural deficiencies. These discussions were near conclusion when she assumed office.


Rather than build on that process, Ms. Usman ignored BUA's requests and obligations under the agreement. In 2016, BUA wrote to the NPA under Article 8.4 of the lease, mandating concessionaires to report environmental and safety concerns and to seek approval for remedial works. Rather than act constructively, Ms. Usman used that letter as a pretext to issue a termination notice and summarily shut down the terminal, without providing any prior warning, consultation, or invoking the dispute resolution clause.


She forgot or failed to disclose in her response that the NPA, under her leadership, was itself in material breach of core obligations including, failing to hand over critical portions of the port, leaving derelict iron ore on the berths, failing to dredge or repair quay walls, and neglecting to provide mandatory security. These lapses were significant impediments to BUA's operations and, as a result, led to disputes between the parties.


ILLEGALITY, CONTEMPT, AND DISREGARD FOR CONTRACTUAL MECHANISMS

After the unlawful termination, BUA approached the Federal High Court, which promptly granted an injunction restraining the NPA from proceeding with termination. The NPA itself then referred the dispute to arbitration, as stipulated in Section 17.3 of the agreement, which clearly states:

“Any dispute, controversy or claim... shall be exclusively and finally settled pursuant to the dispute resolution process prescribed in this Article.”

Despite this, Ms. Usman, against the advice of her agency, unilaterally decommissioned the berths, thereby violating both the agreement and a court injunction. To be clear, the concession agreement granted her no such power to decommission. If she believes otherwise, we invite her to publicly cite the specific clause that authorizes this action.


To further compound the illegality, BUA—after providing the guarantees and indemnities requested by the NPA—was permitted to resume operations briefly. Merely three weeks later, the terminal was again shut down, this time by Ms. Usman's instruction. This left no doubt that her actions were motivated not by due process, but by personal animosity and abuse of office.


BUA subsequently filed contempt proceedings and was looking at estimated losses in excess of $10 million. These proceedings were only withdrawn out of respect for national interest and following the intervention of well-meaning Nigerians within and outside the government.

PRESIDENT BUHARI WAS NOT MISINFORMED—HE ACTED ON FACTS AND LAW

Ms. Usman's claim that former President Muhammadu Buhari was “misinformed” when he reversed her actions is false, disrespectful, and disingenuous.


Following a meeting that our Chairman had the privilege of holding with President Buhari in 2018, he presented the matter to the President, who then directed the Office of the Attorney General of the Federation to conduct a thorough legal review and investigate the situation. The AGF invited all parties, including Ms. Usman, to several meetings. We never saw her at any of them.


Nevertheless, the AGF proceeded to undertake a comprehensive review of the contract, the litigation, the arbitration clause, and all correspondence and actions by BUA and NPA. The legal advice (attached herewith) found that the termination was unlawful, the decommissioning was without any legal basis, and that BUA's rights should be reinstated.


It was on this basis that President Buhari ordered the reversal of her unlawful actions. His intervention preserved the sanctity of the contract, saved over 4,000 jobs, and BUA's $500 million integrated investment cluster involving flour, pasta, and sugar processing facilities which were all dependent on terminal access. For this, we remain deeply grateful to former President Buhari.


As our Chairman said in his interview, imagine if he wasn't privileged to have access. Nonetheless, this culture of impunity has been significantly curtailed under President Tinubu's leadership, as many are aware they could be dismissed or imprisoned if they abuse their positions.

POST-HADIZA: DUE PROCESS RESTORED, INVESTMENT RESUMED

Following Ms. Usman's removal from office, the NPA, under new leadership, implemented the AGF's position. In 2022, BUA was granted formal approval to resume reconstruction works. The contract was awarded to TREVI, and BUA has since invested over $65 million—entirely self-funded and with no recourse to public funds or subsidies. Work is ongoing and completion is expected in the first quarter of 2026.

THE REAL DANGER: INVESTOR CONFIDENCE AND RULE OF LAW

We must state clearly that this matter goes beyond BUA. Had Ms. Usman's actions been allowed to stand, it would have sent a disastrous signal that contracts in Nigeria are worthless, court orders are optional, and public institutions or individuals can act unilaterally without consequence. We must never return to that era.


Nigeria's reform success today is rooted in respecting contracts, due process, and investor confidence—principles being restored under President Tinubu's istration, under which BUA has committed over $1 billion in new investments across energy, food processing, manufacturing, infrastructure and social interventions.


We wish to emphasise that Ms. Usman is entitled to her opinions, irrespective of how distorted they may be. However, she is not entitled to distort the facts or rewrite history. We do not seek a public spat and would like her to concentrate on fulfilling her duties in her new role under the strong leadership of President Tinubu.


We therefore simply restate the facts that Ms Hadiza Bala-Usman had no authority to decommission Terminal B unilaterally. She also acted in defiance of a court injunction and contractual procedure and her actions caused significant economic loss of over USD10 million, reputational risk to BUA, and investor concern for Nigeria.


Our core message remains the same: public office should be viewed as a position of trust rather than a platform for personal biases. Those granted public power need to resist the temptation to let prejudice, ego, and vendetta influence their actions.


If Ms Hadiza Bala-Usman believes she acted lawfully, we challenge her to cite the specific clause or clauses that guided her unlawful actions. If not, let the facts remain where they belong — in the public record.

BURATAI COMMENDS PRESIDENT TINUBU'S RADICAL POLICY APPROACH AT AMAEICHI’S 60TH BIRTHDAY LECTURE


His Excellency Ambassador Lieutenant General Tukur Yusufu Buratai (Rtd), former Chief of Army Staff, delivered compelling remarks at the commemorative lecture marking the 60th birthday of Nigeria’s renowned politician and statesman, Rotimi Chibuike Amaechi, held in Abuja on 31 May 2025.



In his remarks, Buratai paid homage to the celebrant, acknowledging his longstanding relationship dating back to 2011 when Amaechi was governor of Rivers State. He described Amaechi as a leader deeply committed to security and political development, noting his performance at the APC 2022 presidential primaries and his promising political future.



"Rotimi Amaechi exemplifies a leader who prioritizes security, a trait crucial for Nigeria’s stability," Buratai remarked. He praised the former governor’s proactive engagement in Nigeria’s political landscape, emphasizing his significant influence and leadership potential. Buratai also took the opportunity to commend President Bola Tinubu’s government for adopting a radical approach to resolving Nigeria’s economic problems through decisive policies, a move he described as a "necessary departure" from previous graduations approach to economic reforms by the previous istrations. He explained that while past istrations, from IBB’s structural adjustment programs to those of Shagari, Obasanjo, Jonathan, and Buhari, fuel subsidy regimes, they implemented economic reforms that gradually pauperized Nigerians. However, the current istration’s decisive and comprehensive economic policies represent a bold attempt to address deep-seated socio-economic issues confronting Nigeria over the years. Buratai said this bold measure has its advantages. Deep understanding is required to allow for the realization of its benefits.



"The radical measures are a decisive shift from the gradual suffering in the past," Buratai stated. "It shows a willingness to confront the challenges head-on, even if the impact is profound and immediate."


However, he acknowledged that the main challenge remains the perceived insensitivity of government policies to poverty and insecurity, which are real. He postulated that the second half of this istration may make a tangible difference.



Buratai’s speech underscored the importance of embracing reform with resilience and urged Nigerians to Tinubu's government’s efforts to restore security and economic prosperity. Lance Corporal Chikere Vitus Enyioma, an irer of the former Chief of Army Staff (COAS), Lt. General Tukur Buratai has given reasons why Nigerians would not forget the retired Army boss in a hurry.

In a statement, Enyioma explained that, "I ed the Nigerian Army in 2014 with the full intention of serving my country diligently. My first posting was to 1 Division Kaduna, where I was influenced by a common belief among the junior ranks—that our generals didn't care .

"However, that perception changed when Lt. Gen. Tukur Buratai assumed full command and began to truly work and serve both Nigeria and the Nigerian Army.

"Later, I was transferred to Abuja and had the rare opportunity to serve directly in his office as an office orderly. It was there I witnessed firsthand the incredible demands of serving as the Chief of Army Staff. I a specific week where he worked day and night without rest. During a particularly intense period of operations against insurgents, he broke down after a night of nonstop work and back-to-back high-level meetings.

"I was sent by his MA and I had to rush downstairs to get the medical representative, who istered treatment to help him recover. To my surprise, as soon as he regained his strength, he returned immediately to his desk to continue working.

"Throughout my time working in his office, I never saw him take a leave or even a break. Under his leadership, long-forgotten allowances were restored, Many non-commissioned officers were promoted or commissioned. Soldiers were given access to both military and civilian education programs—of which I was a beneficiary.

"He also expanded housing schemes and introduced mortgage opportunities for personnel. Lt. Gen. Buratai redefined what it meant to serve with commitment and vision and every other Staff officer under him were equally busy.

"Under Buratai’s leadership, the Nigerian Army successfully reclaimed large swathes of territory previously under Boko Haram’s control in Borno, Adamawa, and Yobe States. Major highways like the Maiduguri-Bama and Damaturu-Maiduguri roads were reopened, allowing for the restoration of civil governance in formerly overrun regions.

"He initiated the creation of vital commands and formations to improve rapid response, including Nigerian Army Special Forces Command, Army Aviation Corps. These formations enhanced operational flexibility and strengthened counter-insurgency efforts.

NGO launches free medical outreach for over 500 beneficiaries under Tukur-Tukur Foundation in Kaduna


A non-governmental organization, under the auspices of De-Lace International in collaboration with Tukur-Tukur Foundation,n has launched a free medical outreach program in the Kaduna community.

The Chairman of Tukur-Tukur Foundation, Col.Haruna Idris Zaria (Rtd,) said the Foundation is committed to carrying out humanitarian interventions across the country whenever the need arises through the provision of medical succor to the vulnerable, underprivileged of the society by giving them free medical services.

"Tukur-Tukur Foundation carries out free eye screening and cataract surgery; minor eye problems are treated with drugs, drops/ointments, and reading glasses are issued free. We give our wheelchairs and crutches to physical disabilities to ease their daily movement. We equally give our free educational materials such as school uniforms, textbooks, exercise books, etc. Tukur-Tukur Foundation also gives out religious books for spiritual upliftment. Col. Zaria said.

Earlier, the Managing Director of De-Lace International, Hajiya Safiya Bashir, expressed gratitude to the grand Patron of Tukur-Tukur Foundation, Lt. General Tukur Yusufu Buratai (Rtd), for the opportunity given to her organization to launch the free medical outreach for the benefiting community.

In this present generation, the power of man is not enough to survive. This is a generation of warfare, a generation where unseen forces seek dominance, and many mistakenly think they can live casually, without spiritual power.

The truth is:
In a world full of spiritual battles, you either become a slave or an overcomer. You are either a prey or a predator.

A powerless life is not a life worth living.

The Power of God is awesome, absolute, and incomparable. Yet, the power of God does not come overnight. It is a gradual, deliberate process.

If you seek quick and cheap power, you are not seeking the true power of God. Divine power must be sought, grown, nurtured, and matured until it becomes mighty within you.

How to Receive the Power of God

There are eight key ways to generate the Power of God:

1. Through the Name of Jesus Christ (Philippians 2:10–11)

The Name of Jesus carries unstoppable power. At the mention of His Name, every knee must bow—whether in heaven, on earth, or under the earth.

2. Through the Blood of Jesus

The Blood of Jesus gives you power for cleansing and victory. It purges you from sin and builds a spiritual wall of fire around your life.

3. Through the Word of God

The Word of God is a two-edged sword.
When you quote the Word with authority, demons tremble and bow. Saturating yourself with Scripture makes you spiritually untouchable.

4. Through Fasting and Prayer

Fasting breaks your flesh and humbles your body, opening the gateway for divine power.
- Jesus fasted for 40 days before launching into mighty miracles.
- Daniel fasted for 21 days and received divine revelations and revival fire.
