RIVERS ASSEMBLY IN DISARRAY OVER GOV. FUBARA'S IMPEACHMENT The Supreme Court judgment on the Rivers State political crisis has thrown the Martin Amaewhule-led House of Assembly into deeper division, as plans to impeach Governor Siminalayi Fubara have sparked internal chaos. Inside sources reveal that tensions escalated during plenary when deliberations on extending a 48-hour ultimatum against the Governor took an unexpected twist. One lawmaker pushed for immediate impeachment proceedings, but his colleague from the Ijaw extraction vehemently opposed the move, setting off a heated argument. Another legislator, apparently taking directives from someone he tagged "Oga," likely to be the minister of F.C.T, Chief Nyesom Wike insisted they must follow instructions, Amaewhule had to grant another 48-hour extension to calm the situation. But the chaos didn't end there. Sources further disclosed that five lawmakers, allegedly favoured by the FCT Minister, broke away after plenary for a closed-door meeting while others waited, fueling speculations of a deepening rift. The lawmakers from Ijaw extraction strongly opposed the impeachment bid, arguing that it was a ploy to push the Governorship ambition of Martin Amaewhule, an Ikwerre son from Obio/Akpor. To them, this was not just an attack on Fubara but an orchestrated power grab designed to keep Rivers State under the control of the same political dynasty. As it stands, Rivers people are watching closely. Who blinks first? |

Withdraw summons on RSIEC chairman or face court action’ — Lawyer dares Rivers Assembly The political crisis in Rivers State deepened further on Wednesday as the Martin Amaewhule-led Assembly has been threatened with legal action over summons issued to the chairman of the state electoral commission. A lawyer, Kenneth A. Amadi, representing the Association of Legislative Drafting and Advocacy Practitioners, ALDRAP, in a pre-action notice, asked the Assembly to withdraw the ‘illegal’ summons issued to the Chairman of the Rivers State Electoral Commission, RSIEC, Retired Justice Adolphus Enebeli, or face court action. Earlier on Wednesday, 5th March 2025, the Rivers State House of Assembly had given the RSIEC chairman 48 hours to appear before it over the 5th October 2024 local government election, which it said the electoral commission conducted in defiance of a subsisting court order. The Assembly directed the RSIEC chairman to appear before the lawmakers on Friday, 7th March 2025, with all the commissioners of the electoral body. The RSIEC chairman was also directed to present relevant documents that empowered him to spend the Commission’s funds “without an Appropriation Law from 1st January 2024 to date”. The RSIEC chairman was warned that should he fail to honour the summons, the Assembly would issue a warrant of arrest against him, or invoke its powers as enshrined in Section 129 of the Constitution. Reacting to the development in a pre-action notice addressed to the Speaker of the Rivers State House of Assembly, ALDRAP, through its lawyer, Kenneth Amadi, described the summons as illegal and asked the lawmakers to withdraw it. It said the summons violated legal principles and constitutional provisions. “We write to issue this pre-action notice respectfully requesting you and the Honourable Rivers State House of Assembly to withdraw the 48-hour ultimatum issued against the Chairman of the Rivers State Independent Electoral Commission, directing him to appear before your Honourable Assembly. “According to the principles of fair hearing enshrined in both Section 36 of the Constitution of the Federal Republic of Nigeria 1999 and the case law of El-Rufai vs House of Representatives, National Assembly (2003), at least seven (7) days’ notice would suffice to honour an invitation from any legislature according to the Legislative Houses (Powers and Privileges) Act, 2018. “Take notice that in the event that you and the Honourable Rivers State House of Assembly fail to withdraw the said ultimatum, we intend to take steps to approach a court of law to seek redress,” parts of the pre-action notice read. ALDRAP added that it has become necessary to remind the Assembly that Nigeria is a democracy and not a dictatorship where ultimatums are issued without regard to relevant laws. The NGO also offered to provide re-orientation training on legislative procedures for of the Rivers State House of Assembly, at no cost. As a result of the ‘illegal’ summons, the organisation observed that it has become necessary for the lawmakers to be re-acquainted with the scope and limits of the powers of the legislature, as provided by the Nigerian Constitution. Why Sim should not present the budget to this me An advice was given to withdraw every matter between Wike, the 27 defected lawmakers and Governor Fubara by President Tinubu. The Governor obeyed Mr. President and withdrew the case in Court, the aftermath nobody should tell you because two million naira fine (#2,000,000) was paid to court. I want to call the attention of my Governor, presentation or representation of the budget to the reinstated Assembly should be withheld because a question might be asked hereafter if they were truly defected lawmakers or former of the Assembly why did you present the budget to them. Sir, if you can do everything and anything possible within your power not present that document to the defected lawmakers because it is a secret but open document that cannot be given to unknown men and women in the State. ment HomePolitics Rivers Lawmakers’ Defection: Timi Frank Raises Alarm Over Plot To Tamper S’Court Judgement Former Deputy National Publicity Secretary of the All Progressives Congress (APC) and political activist, Comrade Timi Frank, has called on the Supreme Court Chief Justice and the of Justices who heard the recent Rivers State case not to allow desperate attempts to tamper the original judgement. Frank alleged that there were plots by some persons loyal to a former governor of Rivers State to import the issue of defection, which is still at the Appeal Court, into the recent judgement to undermine the ongoing cases. Frank, who raised the alarm through a statement on Tuesday in Abuja, described the move as a “desperate lobby to smuggle into the Judgment an aspect which was not decided.” He accused some loyalists of a former Rivers State governor as brains behind the move. He said: “There is an ongoing plot to doctor the Supreme Court Judgement on Rivers and insert issues of defection that were not litigated by the parties by the pro-Wike group to help destroy the pending cases on defection before the Appeal Court and Federal High Court.” According to him, the issue of defection and legal battle to decide whether they were right or wrong is presently at the Appeal Court and Federal High Court, where Nigerians are waiting to see the judicial interpretation of the illegal act of cross carpeting at a time there was no division which was also backed by a court affidavit sworn to by the defected lawmakers. He said: “We are calling on the Supreme Court Chief Justice and the of Justices who heard the case to ensure that the desperate attempts of the Wike group do not taint their Judgement and that the issue of defection, which is still at the Appeal Court, is not imported into the Judgement to undermine the ongoing cases. “We are confident that the eminent jurist who delivered the Judgment knows the issues at stake and will not fail Nigerians by ensuring that a check is put on the Wike group’s political madness and desperation, which is threatening constitutional democracy in Nigeria. “I have just been reliably informed of a last minute desperate moves by Former Gov.Wike and his lawyers working with some elements in the Supreme Court to use the ongoing writing of the recently delivered Judgement of the Supreme Court on the issue of Rivers LGA election and presentation of Budget to smuggle an item which was never the substantive matter that the Supreme Court decided and which was never part of what was read in the open Court, the issue of the legality of the decampment of the Wike loyal lawmakers from PDP to APC at a time there was no crisis. “This desperate move, which will rubbish the integrity of the Supreme Court if not stopped by our respected jurist, will do irredeemable damage to our nation’s apex and respected Court. “The move is to insert several pages of strange ruling on defection, knowing fully well that the illegal defection of the Wike group of lawmakers was not the subject matter before the Court, but rather on the issue of conduct of LGA election and issue of budget presentation and seizure of federal allocation to Rivers State based on cases they filled even before their defection. “What they want to push into the Judgment secretly was never part of the ruling of the lower courts or the Supreme Court. They are already celebrating, and my in the chamber of one of their lawyers has shown me a draft of what they are confident will be inserted today ahead of the release of the typed CTC of the Judgment today or tomorrow.” Lalasticlala mynd44 mukina2 https://independent.ng/rivers-lawmakers-defection-timi-frank-raises-alarm-over-plot-to-tamper-scourt-judgement/ |
